General Terms and Conditions

Article I. – Introductory Provisions

  1. These General Terms and Conditions govern the rights and obligations of the company DPS RE, s.r.o., with its registered office at Drieňová 27, 821 01 Bratislava – Ružinov district, ID No. (IČO): 50 579 932, registered in the Commercial Register of the Municipal Court Bratislava III, Section: Sro, File No.: 115727/B (hereinafter referred to as the „accommodation provider“), in the provision of accommodation, catering, and complementary services at the GARNI** G HOTEL facility.
  2. The GARNI** G HOTEL facility is located at: Kragujevská 11, 010 01 Žilina, Slovak Republic.
  3. For the purposes of these General Terms and Conditions, a customer is defined as a natural person, natural person – entrepreneur, or legal entity that orders or uses the services of GARNI** G HOTEL (hereinafter referred to as the „client“).
  4. The client may conclude the contract in their own name or in favor of one or more other persons. The client is responsible for ensuring that the persons in whose favor the reservation was made will comply with these General Terms and Conditions.
  5. These General Terms and Conditions form an integral part of the contract for the provision of accommodation, catering, or other services concluded between the accommodation provider and the client.
  6. Different arrangements stated in a written price quotation, reservation confirmation, order, or separate contract shall take precedence over these terms and conditions to the extent that they deviate from them.

Article II. – Booking and Accommodation Reservation

  1. Accommodation or other hotel services can be ordered by the client in person, by telephone, via e-mail, or through the online reservation system.
  2. A reservation is valid upon its confirmation by the accommodation provider. If an advance payment was requested, the reservation is binding only after it has been paid.
  3. The accommodation provider shall supply services to the client in the scope, term, and price stated in the reservation confirmation.
  4. Services are provided directly at the GARNI** G HOTEL facility located at Kragujevská 11, 010 01 Žilina, Slovak Republic. Arrival and departure times, along with any additional conditions, are stated in the reservation confirmation or communicated to the client upon booking.
  5. The client is obliged to pay the price for the ordered services in the manner and by the deadline agreed upon during reservation, at the latest upon departure from the hotel, unless agreed otherwise.
  6. The price of services is stated in the reservation confirmation. The local accommodation tax determined by the generally binding regulation of the city of Žilina is not included in the accommodation price unless explicitly stated otherwise in the reservation confirmation. The accommodation provider collects this tax from the client upon departure as the tax payer.
  7. The accommodation provider is entitled to require a deposit of up to 100% of the price of the ordered services or a payment card guarantee in the form of pre-authorization. If the client fails to pay the deposit within the deadline specified in the reservation confirmation, the reservation expires upon the lapse of this deadline without requiring any further action by the accommodation provider.
  8. In the event of the client’s delay in payment, the accommodation provider is entitled to demand default interest in the amount established by generally binding legal regulations.
  9. The accommodation provider is entitled to offset its due receivables against the client against the paid deposit.
  10. Upon arrival, the client is obliged to present a valid identity document or travel document for every accommodated person for the purpose of fulfilling the accommodation provider’s legal obligations (keeping the accommodation ledger, reporting the stay of foreigners, recording data for the local accommodation tax). If the client or accommodated person fails to present the document, the accommodation provider is entitled to refuse accommodation – in such a case, it shall be handled as a cancellation of the reservation on the day of arrival pursuant to Article III, clause 3.2 letter v).

Article III. – Cancellation Conditions and Refund Policy

  1. The client is entitled to cancel the reservation at any time before the start of the accommodation. Cancellation must be made in writing or by e-mail to recepcia.g-hotelza@dpsre.sk. The date and time of delivery of the cancellation to the accommodation provider shall be decisive.
  2. Upon reservation, the accommodation provider is entitled to charge a cancellation fee in the amount of:
    • 0% of the accommodation price for cancellations 16 or more days prior to the start of the accommodation,
    • 30% of the accommodation price for cancellations 11 to 15 days prior to the start of the accommodation,
    • 50% of the accommodation price for cancellations 7 to 10 days prior to the start of the accommodation,
    • 70% of the accommodation price for cancellations 1 to 6 days prior to the start of the accommodation,
    • 100% of the accommodation price for cancellations on the day of arrival or after 16:00 on the day preceding the arrival day.
  3. If neither the client nor the person in whose favor the reservation was made occupies the accommodation on the arrival day and does not cancel the reservation, the accommodation provider is entitled to charge a cancellation fee of 100% of the accommodation price. In such a case, the reservation expires at 12:00 on the day following the scheduled arrival day.
  4. If the client terminates the stay before the expiration of the agreed period, the price for unused overnight stays is not refundable – this does not apply to the extent that the accommodation provider occupies the room for these overnight stays otherwise.
  5. The accommodation provider is entitled to withdraw from the contract or cancel a confirmed reservation if:
    • the client failed to pay the deposit or the service price properly and on time,
    • circumstances excluding liability pursuant to clause 3.7 prevent the provision of services,
    • a serious operational breakdown, accident, or other circumstance occurs, making it impossible to provide the reserved room,
    • the client or the accommodated person materially breached these terms or the accommodation rules during a previous stay, caused damage to the accommodation provider, or failed to pay for services,
    • the reservation was made with false details or for the purpose of its subsequent paid transfer to a third party.
  6. If the accommodation provider withdraws from the contract pursuant to clause 3.6 letter ii) or iii), they shall offer the client alternative accommodation of comparable category and quality, if available. If the client does not accept the alternative accommodation, the accommodation provider shall refund the paid price for unprovided services within 14 days of the withdrawal.
  7. The accommodation provider is not liable for failure to fulfill their obligations caused by circumstances arising independently of their will (e.g., legally recognized force majeure, natural disasters, utility outages, etc.).
  8. If the client is not a consumer, the payment of a cancellation fee does not extinguish the accommodation provider’s right to compensation for damages exceeding the cancellation fee.

Article IV. – Liability for Damage and Brought-in Items

  1. The accommodation provider is liable for damage to items brought in by or for accommodated natural persons to the extent pursuant to Section 433 et seq. of Act No. 40/1964 Coll., the Civil Code.
  2. For jewels, money, and other valuables, the accommodation provider is liable only up to the amount established by implementing regulations – Government Regulation No. 87/1995 Coll. (EUR 332). This limitation does not apply if the items were taken into safekeeping or if the damage was caused by the staff of the accommodation provider.
  3. The accommodation provider offers free safekeeping of jewels, money, and other valuables at the reception desk.
  4. The right to claim damages for brought-in or deposited items must be asserted with the accommodation provider without undue delay. The right expires if it is not asserted no later than on the 15th day after the day when the injured party learned of the damage.
  5. Parking is provided in an unguarded parking lot. The provision of a parking space does not establish a contract for the safekeeping of the vehicle or items placed within it; therefore, the accommodation provider recommends not leaving valuables in the vehicle.

Article V. – Complaints (Claims)

  1. The client is obliged to point out any defects in the provided services without undue delay upon discovering them, at the latest upon departure from the hotel, so that the accommodation provider can remedy the defect during the stay.
  2. Complaints can be filed in person at the hotel reception or by e-mail at recepcia.g-hotelza@dpsre.sk.
  3. The accommodation provider shall settle the complaint in the shortest possible time, at the latest within 30 days from the date of its filing.
  4. Rights arising from liability for defects are governed by Act No. 108/2024 Coll. on Consumer Protection and the Civil Code.

Article VI. – Out-of-Court Dispute Resolution

  1. The consumer has the right to contact the merchant (accommodation provider) with a request for remedy via e-mail at recepcia.g-hotelza@dpsre.sk if they are not satisfied with the handling of their complaint.
  2. In the event of a negative response or if there is no response within 30 days, the consumer has the right to submit a proposal for alternative dispute resolution to an alternative dispute resolution entity (ADR entity) pursuant to Act No. 391/2015 Coll.
  3. The list of ADR entities is maintained by the Ministry of Economy of the Slovak Republic and is published on its website.
  4. Alternative dispute resolution applies exclusively to distance consumer contracts and compliance with statutory conditions.

Article VII. – Personal Data Protection
